Terms Of Service
Welcome to Eilmou! This document sets out the terms and conditions (called the “Agreement”) between the Eilmou learning platform (called “We”, the “Service”, the “Platform”) and users of the platform (called “You”, the “Users”, the “Students” and the “Instructors”) which apply when you (i) purchase courses), and (ii) purchase or access recorded courses, question bank, homework, materials (hereinafter collectively referred to as “Resources”), and (iii) joining live sessions, and (iv) instructors conducting live sessions from the platform in the form of website or desktop applications and any other related services (each referred to as the “Platform”).
Please read this Agreement carefully before using the Platform. If you have any questions, kindly contact eilmou.com@gmail.com before using the Platform. By signing up for an account or downloading and using the Platform in any way, it will suffice to acceptance of this Agreement.

The Eilmou online learning platform is a jointly-managed service by Barakah Systems Sdn Bhd and Test Center Malaysia, a company incorporated in Malaysia with its office located at 45-3, Jalan Setiawangsa 11A, Taman Setiawangsa, 54200 Kuala Lumpur,
Malaysia.

These are the parties involved in the Platform which are bound to the Agreement:
The Company – The Company manages the Platform which allows Students to join Live Sessions by purchasing Courses, and accessing Resources. Both Instructors and Students are Users of the Platform.
Instructors – Instructors are individuals which are affiliated with the Company and are agents of the Company who conduct Live Sessions and provide Resources for the Courses.
Users – A person who uses the Platform provided by the Company which includes Courses, and Resources.
The language of this Agreement is English. All documents, notices, waivers, variations, and other written communications relating to this Agreement shall be in English. If this Agreement and any document relating to it is translated, the English version shall prevail.
Services
You are required to create an account before using our Platform. When registering for an account, you are required to provide your information including but not limited to, name as per your identification card, email address, password, contact number, date of birth, and current level of study. You may also use other secure sign in/register account method to create an account. You may also have to provide credit card/payment details when purchasing Courses or Resources. You must keep any password(s), other secure sign in methods, payment details private; and prevent others from accessing the Platform with your account. You are responsible for any charges billed by the Platform even if another person uses your account to make the purchase.
You may request to close/delete your account with us at any time by contacting us with the details above, or in the Platform’s contact us section. Accounts deleted are not retrievable; access would be revoked, and details would be erased from our server permanently. We may also close your account if we believe you are abusing our Service (for example, leaving bad reviews, sabotage our students, instructors, or the Platform, making unreasonable complaints, or any other unjustified reasons).

The Service provides access to compiled educational information and related sources. Such information is provided on an “As Is” basis and we assume no liability for the accuracy or completeness or use or non-obsolescence of such information. We shall not be liable to update or ensure continuity of such information contained on the Service. We would not be responsible for any errors, which might appear in such information, which is compiled from third party sources or for any unavailability of such information.
In the preparation of the Service and contents therein, every effort has been made to offer the most current, correct, and clearly expressed information possible. Nevertheless, inadvertent errors may occur. In particular, but without limiting anything here, we disclaim any responsibility for any errors and accuracy of the information that may be contained in the Service. Any feedback from you is most welcome to make the Service better and error free.
We also reserve the right and discretion to make any changes or corrections or withdrawal or addition of content at any time without notice. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered in the Service for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
From time to time the Service may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).
The contents of the Service are developed on the concepts covered in the structured curriculum syllabus prescribed for students of various courses. The usage of the Service is not endorsed as a substitution to the curriculum-based education provided by the educational institutions but is intended to supplement the same by explaining and presenting the concepts in a manner enabling easy understanding. The basic definitions and formulae of the subject matter would remain the same.
We acknowledge that there are various means of delivering structured curriculum pedagogy and inclusion of methods in the Service does not imply endorsement of any particular method nor exclusion imply disapproval. Subscription to the Service or usage of the Service does not in any manner guarantee admission to any educational institutions or passing of any exams or achievement of any specified percentage of marks in any examinations.
Eligibility
Any underage individuals below the age of 18 years old must obtain consent and approval from parents, guardians, or appointed caretakers to use our Platform. By purchasing Courses, and accessing Resources, the user confirms that he or she is at least 18 years old. We reserve the sole and absolute right to refuse services to any persons who are not aged 18 or over unless they can provide valid documentation proving that they are.
Refund
As a User, you hereby agree and acknowledges that there shall be no refund or reimbursement of payments made, unless the refund request was made due to technical faults/errors such as transaction duplicity, data entry mistake or any other circumstances that we at our sole and absolute discretion deem fit.
We reserve the sole and absolute discretion to amend this refund policy from time to time.
Data Protection
We will process User personal data in accordance with our Privacy Policy.
Other Terms
These Terms and any action related thereto will be governed by the Malaysian laws without regard to or application of its conflict of law provisions or your state or country of residence. All claims, legal proceedings or litigation arising in connection with the Service will be brought solely in Malaysia, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum. Nothing herein prohibits or hinders Eilmou from bringing an action in any jurisdiction for injunctive or other preliminary relief.
These Terms are the entire and exclusive agreement between Eilmou and you regarding the Service (excluding any services for which you have a separate agreement with Eilmou that is explicitly in addition to or in place of these Terms), and these Terms supercede and replace any prior agreements between Eilmou and you regarding the Service.
The failure of Eilmou to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. In the event that any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.
